This policy applies to all content hosted on our official website, bengineering-indonesia.com, including but not limited to text, graphics, logos, images, photographs, audio clips, video clips, digital downloads, data compilations, software, and detailed engineering drawings, project specifications, and design documents that are the proprietary assets of the Company or third parties.


Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner or an agent thereof and believe that any content on this website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):

  • A Physical or Electronic Signature: A signature (physical or electronic) of a person authorized to act on behalf of the copyright owner.
  • Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, including, if applicable, a URL or other specific location where the authorized work may be found.
  • Identification of the Infringing Material: A description of the material that you claim is infringing, with enough detail (e.g., the specific URL on our site) to allow us to locate it.
  • Your Contact Information: Your address, telephone number, and email address so that we can contact you.
  • A Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A Statement Under Penalty of Perjury: A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Please be aware that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material is infringing your copyright.

The danger in media concentration comes not from the concentration, but instead from the feudalism that this concentration, tied to the change in copyright, produces.

Counter-Notification Procedure

If you believe that your content was removed (or access to it was disabled) as a result of a mistake or misidentification, you may file a counter-notification pursuant to 17 U.S.C. § 512(g). To be effective, your counter-notification must be a written communication sent to our Copyright Agent that includes substantially the following:

  • Your Physical or Electronic Signature.
  • Identification of the Removed Material: Description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  • A Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your Contact Information: Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which BEN Engineering Indonesia may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • A Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A Statement Under Penalty of Perjury: A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Upon receipt of a valid counter-notification, we will forward it to the original complainant. The complainant must then notify us within 10 business days that they have filed a court action relating to the material. If we do not receive such notification, we may, at our discretion, restore the material.


Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, BEN Engineering Indonesia has a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website and/or terminate the accounts of any users who infringe the rights of any intellectual property rights of others, whether or not there is any repeat infringement.
